On November 25, 2008 plaintiff a 78 year old man was injured in a bicycle vs. tractor-trailer accident at the intersection of Lemon Avenue and Laycross Drive in the City of Industry. The tractor-trailer driver was alleged to have hit the bicyclist without warning. Plaintiff contended the driver failed to yield prior to turning right. Plaintiff contended the driver of the tractor trailer driver violated California Vehicle Code Section 22107 which states that no person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in the vehicle code in the event any other vehicle may be affected by the movement. There were over $2 million in medical bills.

Defendant s denied liability and said the bicyclist was in the driver’s blind spot.

The defendants settled for $5,815,000
